Why Does Family Law Exist?
Family law is a branch of civil law that deals with matters related to the family. The Family Courts are responsible for resolving disputes related to family law in the Turkish Civil Code. All divorce cases must be filed in the Family Courts, regardless of the reason for divorce. In places where there are no Family Courts, the Civil Courts of First Instance handle divorce and separation cases. Divorce is the termination of a legally recognized marriage by court decision, upon the request of one of the spouses, based on reasons and conditions recognized by law. Our family lawyers deal with such matters and provide services in our office.
Some of the Principles Valid in Family Law
1) Absence of freedom of contract:
In family law, there is no room for freedom of will. Parties cannot create legal relationships in family law by their own will that are not regulated by law. For example, they cannot agree on grounds for divorce not recognized by law through an agreement among themselves. Parties cannot change the rules that are established by law.
2) Principle of state intervention:
For example, the marriage ceremony must be performed before an official registrar, or divorce can only be granted by a judge's decision.
3) Principle of equality:
As a rule, equality between men and women is recognized. For example, the grounds for divorce are the same for both husband and wife.
